Guangdong Jiangmen Polytechnic

Guangdong Jiangmen Polytechnic, founded in March 2004, is a state-owned full-time institution approved by the Guangdong province. It is filed by the Ministry of Education. The college currently consists of Jiangmen Education College, Jiangmen Finance and Trade School and Jiangmen Secondary Industrial School which have more than 20 years education experiences. There are more than 450 teachers and nearly 10000 students. The college has seven departments and more than 50 majors are available. The college has four campuses, including the new campus, taking up 1382 mu (the area of the construction is 300 thousand square meters). The initial projects (110 thousand square meters) has be finished at the fall of 2006. We will strictly follow the principles "Promoting college with Technology; Educating Students with Civilization; Running College with Open Minds; Serving the Hometown of Overseas Chinese", to construct education mode with characteristics. According to the demands of market and students employment, we aim at cultivating highly-professional and practical students with "two certificates", which will possess both the ability of innovation and enterprise.

WORK CONTRACT

I.        Party A Jiangmen Polytechnic wishes to engage the service of Party B *Brett Steenberg as an English teacher. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.

II.        The period of service will be from the 1st day of Sep, 2013 to the 30th day of June 2014.

III.        Party B's monthly salary will be ¥7000 (after tax) for his average teaching load of 18 hours per week or ¥6500 (after tax) for his average teaching load of 16 hours per week.

IV.        Probation Period
1.        Party A will set a probation period of one month for Party B upon the first day of the contract.
2.        After the probation period, Party A will require the relevant department to give a comprehensive evaluation of Party B's teaching work and Party B will receive a written notice of the evaluation in 10 days. If the evaluation is up to standard and meet the requirement set up by the department concerned, the contract will be continued. But if the evaluation is not good enough, Party A will have the right to terminate the contract at any time.
3.        During the probation period Party B will receive a regular monthly salary as set in the contract.

V.        Party A's Obligations
1.        Party A shall inform Party B of the laws, decrees and relevant regulations enacted by the Chinese government, the Party A's work system and regulations concerning administration of foreign experts. Party A shall pay for and provide the Foreign Expert's Certificate and Z-visa for Party B.
2.        Party A shall conduct direction, supervision and evaluation of Party B's work.
3.        Party A shall provide Party B necessary living conditions listed below:
Party A provides Party B, free of charge, with a furnished apartment including a gas stove, a microwave oven, a fridge, a sterilizer cabinet, a heater, a washing machine, a color TV, a water dispenser, and an air conditioner.
4.        Party A shall provide Party B necessary teaching conditions (such as the tape recorder, computer and screen in classroom, etc).
5.        Party A shall provide an Internet connection amounting to 90 yuan for Party B in her apartment. The over charge part is paid by Party B.
6.        Party A shall pay Party B's salary regularly by the month.
7.        Party A shall arrange a car or a van to meet Party B on the first day of her reaching China and to see Party B off on the day of his leaving China after the expiration of the contract. Party B shall pay the fare if she needs transportation service at any other time.
8.        Party A provides Party B with the following holidays with pay during each academic year. And Party B must work in accordance with the adjustments of teaching schedule due to the national holiday plans.
1)        China's national holidays, including: New Year's Day (one day, January 1), International Labor Day (one day, May 1), Tomb-sweeping Day (April 5), Dragon Boat Festival (one day, the 5th day of the 5th lunar month), Moon Festival (one day, the 15th day of the 8th lunar month) and Chinese National Day (three days, October 1, 2 and 3).
2)        Summer holidays and winter holidays arranged by Party A within the contract period.
VI.        Party B's Obligations
1.        Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China's internal affairs.
2.        Party B shall observe Party A's work system and regulations concerning administration of foreign experts and shall accept Party A's arrangement, direction, supervision and evaluation in regard to his work. Without Party A's consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.
3.        Party B shall respect China's religious policy, and shall not conduct religious activities incompatible with the status of a foreign teacher.
4.        Party B shall respect the Chinese people's moral standards and customs.
5.        Party B teaches Party A's students for an average load of 16 teaching hours per week. If Party B has not met the average teaching load limit of 16 hours per week, Party A has the right to add more to him (if necessary).
6.        Party B shall complete all necessary preparation for classes and correct necessary homework of the students, and guarantee the quality of work.
7.        Party B provides Party A's teachers and students with academic guidance in their extra curriculum activities (such as English corner).
8.        Party B shall maintain a professional manner and appearance at work. Party B shall attend classes on time and should not end class before the scheduled time.
9.        Party B shall buy cooking gas, gas bottles and cooking stove if she needs them.
10.         Party B shall pay the part of the expense of electricity and water over the quota given by Party A, which is 4 tons of water and 200 kwh of electricity monthly.
11.        Upon termination of this contract, Party B shall return all property that is in Party B's possession or under Party B's control.
VII.        Revision, Cancellation and Termination of the Contract
1.        Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.
2.        The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
3.        Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
(1)        Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after party A has pointed it out.
(2)        According to the doctor's diagnosis, Party B cannot resume normal work after a continued 30-day sick leave.
4.        Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
(1)        Party A has not provided Party B with necessary working and living conditions as stipulated in in Item V in this contract.
(2)        Party A has not paid party B as scheduled (except weekends and summer holidays and winter holidays).
VIII.        Breach penalty
When either of the two parties fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract; it must pay a breach penalty of ¥6,500.
If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain party A's consent, and pay its own return expenses; if Party B cancels the contract without valid reason, it would pay its own return expenses and pay a breach penalty to Party A.

IX.         Insurance
1. Party B shall get her medical insurance (and other kinds of insurance if necessary ) in her own country and bear all the expenses himself.
2. Party A shall provide Inpatient Medical Insurance and Casualty Insurance for Party B as offered in China under law.

X.        The Appendixe of this contract is an inseparable part of the contract and have equal effect.

XI.        This contract must be signed by both parties, but it won't take effect until Party B has got the working permit, the working visa and the residence permit issued by the relevant department of the Chinese Government and has begun his work in Jiangmen Polytechnic. The contract will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.
If no new contract is signed, Party B must move out of the apartment before the end of the day of the contract expiration and bear all expenses incurred afterwards.

XII. Arbitration
The two parties shall consult with each other and mediate any disputes that may arise about the contract. If all attempts fail, the two parties can appeal to the Foreign Expert Bureau of Guangdong Province for a final arbitration.

This Contract is signed at Jiangmen Polytechnic, in duplicate, the 29th day of June, 2013, in the Chinese and English languages, both texts being equally authentic.

Appendix:


Salary:
1.        The salary of Party B shall be determined in light of the duties to be undertaken and the professional skill demonstrated, with reference to its academic training, qualifications and experience. Party A shall inform Party B of the amount of salary before he consents to accept the position.
2.        Salary is paid monthly, beginning on the date of the assumption of responsibilities by Party B and ending on the date of the expiration of the contract (Party B is expected to stay until the end of the contract). If Party B should work less than a month, payment would be made according to the following formula:"1/30 the month salary ×the days Party B has worked."
3.        If Party B works in Jiangmen Polytechnic for a whole academic year, his salary will be paid as usual for the winter/summer vacation. If a new contract is signed for another continuous academic year or semester, salary will also be paid as usual for the summer/winter vacation. But in these two cases, the salary for holidays will be paid upon Party B's return for the new semester and the termination allowance will not be paid until the expiration of his final contract.

Sick Leave and Leave for Personal Matters:
1.        Party B can ask for sick leave (He must be medically certified) or ask for leave on account of private business. But before he leaves, Party B must first get a written permission of both the Dean of the relevant department and the Director of the Foreign Affairs Office.
2.        In total, sick leave should not exceed more than 30 days during one academic year of the contract period (15 days during one semester). If the sick leave exceeds that limit, Party A will have the right of proposing termination of the contract.
3.        In total, leave for private business should not exceed more than 10 days in one academic year of the contract period and each leave must be within 3 days (5 days during one semester) and the longest leave should not exceed 3 days. Party A will have the right of proposing termination of the contract if the leave exceeds that limit.
4.        Party B is not allowed to switch his classes for leave without any special reasons.

Termination and Travel Allowance:
After at least one academic contract year of service if no new contract is signed, a termination allowance of ¥6500 for service will be granted to Party B for a return-trip air-ticket. No termination allowance will be granted for service of less than one academic year.
An annual travel allowance of ¥3000 will be provided for summer vacations if a new contract is signed.
A transportation subsidy of ¥100 will be provided monthly to Party B.
