Employment Contract



Party A: Jining Foreign Language School


Party B:


I. Party A wishes to engage the service of party B__________________ (Passport Number_________) as ____________________. The two Parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it. The period of service will be from Sep 1st ,2012 to the last day of June 30th ,2013.


II. Party B’s monthly salary will be ¥8300RMB before tax.



III. Party A’s Obligations and Duties


  1. Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign teachers.
  2. Party A shall conduct direction, supervision and evaluation of Party B’s work.
  3. Party A shall Provide Party B with necessary working conditions.
  4. Party A shall provide co-workers and coordinators if necessary.
  5. 40% of the salary will be paid on the 5th and 60% will be paid on the last day of each month.
  6. Party A is responsible for Party B’s work visa and expert certificate to make sure Party B’s work is within the Chinese law and Party A will pay the relevant expenses on them.
  7. Party A shall provide three meals a day in the work days except supper on Friday (together with other Chinese teachers) and a free apartment with paid utilities.
  8. Party B can go to the local hospital designated by Party A. Party A will only reimburse Party B’s medical expenses incurred at the designated hospital. The maximum allowance for medical expenses is RMB1000 per year and Party B is responsible for expenses that exceed the maximum allowance.
  9. Party A will buy an accident insurance for Party B.
  10. A. Upon full attendance without any leave or lateness or absence, Party A shall offer 500RMB at the end of each semester as a bonus.


B. Less than 3 days' (including 3 days) leave or lateness or absence, Part A shall offer 80% of full attendance bonus at the end of each semester.


C.3 to 5 days' leave or lateness or absence, Part A shall offer 60% of full attendance bonus at the end of each semester.


D. More than 5 days' (including 5 days) leave or lateness or absence, all 500 RMB will be deducted.




  1. Party B can have a one day off both on Christmas Day and on Easter Day.


  2. Upon successful completion of contract, Party A shall compensate Party B for air travel expenses according to the length of contract: One year: airfare to a maximum of 10,000RMB ,it will be paid separately, at the end of the each semester. If part B cannot provide air ticket with his/ her name signed plus a tax stamp or an air ticket invoice, Part A shall still offer 3,000RMB as a compensation for air travel each semester.


  3. Party B can get a bonus at the end of each semester according to the performance.


14.Party A shall offer salary in winter holidays (around 25 days), and one month salary in summer holidays upon Party B’s renewal for the school year 2013 to 2014.


IV. Party B’s obligations


15.Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China’s internal politics affairs.


16.Party B shall observe Party A’s work system and regulations concerning administration of foreign teachers and shall accept Party A’s agreement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any position unrelated to the work agreed on with Party A.


17.Party B shall complete the tasks agreed on schedule and guarantee the quality of work.


18.Party B shall respect China’s religious policy, and shall not conduct religious activities incompatible with the status of a teacher.


19.Party B shall respect the Chinese people’s moral standards and customs.


V. Party B’s Duties


20.The contracted working hours for Party B shall be within 8 hours each day per week during 5 weekdays, less than 18 periods (35 minutes each). Party B shall share the class teacher’s duty with a bilingual teacher appointed by Party A. The duty includes organizing the class together with the Chinese classroom teacher harmoniously, attending all the class activities during the weekdays, meeting with the parents on Friday afternoons and helping solve the problems occurring unexpectedly during the class.


21.Party B shall be punctual for class. Party B may be observed and evaluated by Party A in the classroom as required and get feedback as well.


22.Part B shall be at school during the work-time in the five-day work week checking students’ exercises and preparing lessons when they have no classes. Party B shall follow the temporary adjustment in the teaching schedule because it may be modified to accommodate examinations and holidays.


VI. Breach Penalty


23.Party B shall be punctual. If Party B fails to go to class on time, a fine will be conducted as follows:


(1) 100RMB will be deducted if anyone happens to be late.


(2) 200RMB will be deducted if anyone happens to miss one period.


24.Absence without notification will result in a financial fine or may lead to contract termination. The director of your department has the authority to grant absences of 1/2 a day in length. Vice principle has the authority to grant absences of up to 2 days in length. Only the principle can approve of absence longer than 2 days in length.


25.Party B can ask for 3 days private affairs leave in one semester. Party A has the right to terminate the contract if Party B’s private affairs leave totals more than 3 days during one semester. If Party B gets permission for leave during any normal working days, their salary shall be deducted at the rate of 1/30 of the monthly salary per day.


26.A request for sick leave by Party B must be substantiated by documentation from an approved hospital/doctor. Party B can ask for 3 days sick affair leave in one semester with no deduction from his/her salary. When it comes over 3 days, Party B will get his/her salary deducted at the rate of 1/30 of the monthly salary per day. Party A has the right to terminate the contract if Party B’s sick leave totals more than 10 days during one semester.


27.Party B is obliged to inform Party A in written form beforehand in case of illness or absence. If Party B fails to inform Party A, Party B shall be liable to inflict a financial penalty. If Party B repeats such act, Party A has the right to terminate the employment contract and ask for compensation for Party B’s breach of contract.


28.When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract; it must pay a breach penalty of 5000RMB.


VII. Revision, Cancellation and Termination of the Contract Party


29.Both Parties should abide by the contract and refrain from revising, canceling, or terminating the contract without mutual consent.


30.The contract can be revised, cancelled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.


31.Party A has the right to cancel the contract with written notice to Party B under the following conditions.
(1) Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.
(2) According to the doctor’s diagnosis, Party B cannot resume normal work after 3 days sick leave.


32. Party B has the right to cancel the contract with a written notice to party A under the following conditions:
(1) Party A has not provided Party B with necessary working conditions as stipulated in the contract.
(2) Party A has not paid Party B as scheduled.


VIII. Arbitration




  1. The two parties shall consult with each other and mediate any disputes, which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign expert affairs in the State Bureau of Foreign Experts and ask for a final arbitration.
    This contract is signed and duplicated, on this day of 2012, in the Chinese or English languages, both texts being equally authentic.
